Can a presumtion be met with prime penalty? The Hon'ble Supreme Court virtually decided this aspect in a case of dowry death. In the result the Court held that life imprisonment being the maximum punishment for the offence shall only be awarded in rare cases.
The bench comprising of Hon'ble Justices P Sathasivam and H L Dattu reduced the verdict of life imprisonment of accused G.V.Siddaramesh to 10 years who was punished by Sessions Court for the death of his wife Usha.
The Court also cited another judgement Hemchand V State of Haryana to substantiate its verdict and pointed out that the offence of 304 B in IPC only says about a presumption of dowry death. The minimum punishment is 7 years for the offence. However the Court considered the age also of the convict and reduced the life sentence imposed upon him.
